Ephesians 6 Ministries — Terms of Use

Preamble

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING THE EPHESIANS 6 MINISTRIES APPLICATION (THE "APP"). BY CREATING AN ACCOUNT, ACCESSING, OR USING THE APP IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

1. Parties and Acceptance

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ephesians 6 Ministries, including its officers, directors, employees, volunteers, agents, licensors, affiliates, successors, and assigns (collectively, "Ephesians 6 Ministries," "we," "us," or "our"), governing your use of the App and all related content, features, and services.

By accessing the App, you represent that you are at least 18 years of age, or if under 18, that you have obtained verifiable parental or guardian consent.

2. Description of the App and Subscription Tiers

The App provides faith-based spiritual formation content organized into three subscription tiers: Novice (Free), Pro (Coming Soon), and Parish (Coming Soon). The Novice tier includes daily Horse & Chariot video content via Vimeo, daily prayer with push notification, daily meditation on the Armor of God, a daily virtue practice prompt, and a weekly newsletter. Pro adds personalized virtue training, community features, and AI-assisted personalized evaluations. Parish adds pastor-uploaded content and parish community features.

3. AI-Assisted Content

All tiers of the App incorporate artificial intelligence ("AI") to generate or personalize content, including daily prayers, meditations, virtue training recommendations, Armor of God reflections, virtue practice prompts, check-ins, and evaluations.

AI-generated content is provided for general informational and spiritual enrichment purposes only. It does not constitute professional theological, psychological, medical, legal, or financial advice. AI systems may produce errors or content that does not reflect official Church teaching, your denomination's doctrine, or your personal circumstances. Ephesians 6 Ministries does not guarantee the accuracy, completeness, or theological precision of any AI-generated content. You are solely responsible for evaluating and applying it in your spiritual life.

4. Not a Substitute for Professional Services

THE APP AND ALL CONTENT PROVIDED THEREIN — INCLUDING AI-GENERATED CONTENT, PRAYERS, MEDITATIONS, VIRTUE TRAINING, CHECK-INS, AND EVALUATIONS — ARE NOT A SUBSTITUTE FOR licensed mental health counseling or therapy; psychiatric or psychological treatment or diagnosis; pastoral counseling or spiritual direction by a qualified minister; medical or clinical care of any kind; or legal, financial, or other licensed professional advice.

If you are experiencing a mental health crisis, suicidal ideation, domestic violence, substance use disorder, or any other condition requiring professional intervention, please immediately contact a qualified licensed professional, emergency services (911), or a crisis hotline such as the 988 Suicide and Crisis Lifeline (call or text 988).

Ephesians 6 Ministries expressly disclaims any duty of care arising from the use of the App in connection with mental, emotional, psychological, or physical health matters.

5. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Ephesians 6 Ministries expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement; that the App will be uninterrupted, error-free, secure, or free of viruses; regarding the accuracy, reliability, or completeness of any content, including AI-generated content; and that the App will meet your spiritual, emotional, or personal needs.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EPHESIANS 6 MINISTRIES, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AGENTS, LICENSORS, PARTNERS, OR SUCCESSORS BE LIABLE FOR ANY direct, indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, data, goodwill, or other intangible losses; damages arising from your use of or inability to use the App; damages arising from reliance on any content, including AI-generated content; damages arising from unauthorized access to or alteration of your transmissions or data; or damages arising from any mental health, psychological, emotional, or physical harm.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if Ephesians 6 Ministries has been advised of the possibility of such damages. In jurisdictions that do not allow such limitations, our total liability shall be limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00).

7. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Ephesians 6 Ministries and its affiliates, officers, directors, employees, volunteers, agents, licensors, and assigns from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of or access to the App; your violation of these Terms or any third-party rights; any content you submit; your reliance on any App content, including AI-generated content, in lieu of professional services; or any claim that your use of the App caused harm to a third party.

8. Community Features and User Content

Pro and Parish tier users may access community features including prayer walls, encouragements, and challenges. By submitting content, you grant Ephesians 6 Ministries a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content within the App; represent that your content does not infringe any third-party rights; and agree not to submit content that is unlawful, defamatory, abusive, harassing, or contrary to Christian charity. We reserve the right, but not the obligation, to monitor, edit, or remove user-generated content.

9. Purchases, Subscriptions, and No-Refund Policy

The Novice tier is free. Pro and Parish tiers require a paid subscription. ALL PURCHASES, INCLUDING SUBSCRIPTION FEES AND ANY IN-APP PURCHASES, ARE FINAL AND NON-REFUNDABLE, regardless of whether you cancel before the end of a billing period, fail to use the App, are dissatisfied with any content, experience technical difficulties outside our reasonable control, or purchased a tier whose additional features are listed as "Coming Soon."

Subscriptions automatically renew unless cancelled prior to the renewal date. You may cancel at any time through your account settings or by contacting us; cancellation takes effect at the end of your current paid billing period and does not entitle you to a refund. We reserve the right to modify pricing upon reasonable advance notice. Purchases are processed through third-party processors (Apple App Store, Google Play, or Stripe) whose terms also apply.

10. Third-Party Services

The App integrates third-party services, including Vimeo for video content delivery and push notification providers. Your use of such services is governed by their respective terms of service and privacy policies. Ephesians 6 Ministries is not responsible for the content, practices, or policies of any third-party service.

11. Intellectual Property

All content, trademarks, logos, graphics, text, and software within the App are the property of Ephesians 6 Ministries or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to reproduce, distribute, or create derivative works from App content without express written permission.

12. Privacy

Your use of the App is subject to the Ephesians 6 Ministries Privacy Policy, which is incorporated herein by reference. By using the App, you consent to the collection and use of your information as described therein.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Notice of material changes will be given by updating the effective date and, where practicable, by in-App notification. Your continued use of the App following such notice constitutes acceptance of the revised Terms.

14. Termination

Ephesians 6 Ministries may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, all licenses granted to you under these Terms will immediately cease. Sections 4 through 7 and 11 through 16 shall survive any termination.

15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State in which Ephesians 6 Ministries is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

16. General Provisions

If any provision of these Terms is unenforceable, the remaining provisions shall remain in full force. These Terms constitute the entire agreement between you and Ephesians 6 Ministries with respect to the App and supersede all prior agreements. Our failure to enforce any right or provision shall not be deemed a waiver.
